General terms and conditions of business
§1 Scope, customer information
For all business contacts between DR. MED. SHIRIN MANSOURI - HYPNOSIS, SEMINARS & WEBINARS and its participants, the following General Terms and Conditions of Participation (GTC) in the currently valid version apply exclusively. Deviations from these conditions and ancillary agreements must be made in writing. The following General Terms and Conditions regulate the contractual relationship between the customer and Dr. med. Shirin Mansouri, Grüneburgweg 87, 60323 Frankfurt am Main, Germany.
Any deviating general terms and conditions of the participant will be rejected. By registering for the seminar or booking consultation/deep relaxation, the participant accepts these terms and conditions.

a. Definition of customer

Customer is: the participant/company in seminars and webinars as well as the person who books participation in seminars and webinars for third parties.
​
A customer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

b. Designation of persons

In this text, we only use the male form to refer to people in order to keep the text clear. We ask for your understanding. Of course, all information applies equally to women and men.

§2 Seminar registration
You can register for a seminar by mail or online via our homepage www.drshirinmansouri.com .
If you do not use our booking system for this purpose, we ask that you provide us in writing with the full name of the participant, the full company and billing address including telephone and fax numbers, as well as a corresponding email address and an indication of whether you are booking the seminar as a corporate customer or as a private individual.
In the case of a telephone registration, a written confirmation of this telephone registration is required from you in order to make a binding booking for the seminar, stating the full name of the participant, the full company and billing address including telephone and fax numbers, a corresponding email address and an indication of whether you are booking the seminar as a corporate customer or as a private individual.

a. Registration confirmation
You will receive a written registration confirmation from us (by email or post) with details of the seminar, an invoice and directions. If the seminar you have booked is already fully booked, we will inform you immediately. Your registration is considered accepted if we have not rejected it within 14 days of receipt of the registration.

b. Right to participate
There is no general right to participate; we reserve the right to admit participants on a case-by-case basis. By registering, you are committing to participating in the entire seminar. We will not refund any costs for late arrival or early departure.

For seminars with a limited number of participants, registrations will be considered in the order in which they are received. Participants' data will be processed electronically for internal purposes. The data associated with the registration will be stored in compliance with data protection regulations.

c. seminar fees
​
The applicable seminar fees are listed on our booking page and on the respective seminar content pages. The prices of the seminar program valid at the time of registration apply. The seminar fee includes the seminar (fees, organizational and incidental costs) as well as a confirmation of participation in the seminar. You organize/book and pay for your arrival/departure and overnight stay(s) yourself.

You will receive an invoice with your registration confirmation. Payment is made without any deductions. The fee is due upon invoicing unless another payment date is specified. It must be transferred to the account specified on the invoice.
For some seminars, a registration fee is payable which is non-refundable. In the event of cancellation or rebooking, this registration fee is forfeited. Offsetting against the fee is only permitted if the counterclaims of DR. MED. SHIRIN MANSOURI - HYPNOSIS, SEMINARS & WEBINARS are recognized or legally established. Rights of retention are excluded.

d. Short-term registrations
For short-term registrations (less than 14 days before the start of the seminar), the seminar fee must be paid immediately and the right of cancellation no longer applies. Rebookings are no longer possible.

§3 Cancellation and modification by the participant
You can cancel or rebook your booked seminar before the seminar begins or name a substitute:

a. Cancellation
​
If the participant is unable to attend the seminar/coaching, the customer will not incur any additional costs beyond the registration fee of 30% of the contractually agreed seminar fee if DR. MED. SHIRIN MANSOURI - HYPNOSE, SEMINARE & WEBINARS has received written cancellation by post at least 4 weeks before the start of the seminar. If the written cancellation is received by DR. MED. SHIRIN MANSOURI - HYPNOSE, SEMINARE & WEBINARS up to 2 weeks before the start of the seminar, 50% of the contractually agreed seminar fee must be paid, after which the full seminar fee is due.
b. representation
You have the opportunity to nominate a replacement participant up to 48 hours before the start of the seminar, provided that they meet the requirements for participation; here too, we reserve the right to allow participation on a case-by-case basis. The replacement participant must register separately. There are no additional costs for you or the replacement participant.

§4 Cancellation of seminars by Dr. med. Shirin Mansouri - Hypnosis, Seminars & Webinars
We reserve the right to cancel seminars due to insufficient number of participants (at least 10 days before the scheduled seminar date) or for other important reasons for which we are not responsible (e.g. sudden illness of the speaker, force majeure).

a. Seminar cancellation
We reserve the right to cancel a seminar for important reasons. In this case, we will refund all seminar fees paid. Due to force majeure or the absence of a trainer, a seminar can also be cancelled immediately before and during the seminar. In these cases, we are only obliged to refund a proportion of the seminar fees already paid.

b. Exclusion of liability and claims for damages
Further liability and damage claims are excluded unless they are based on intentional or grossly negligent conduct on the part of our legal representatives or employees or other vicarious agents.

c. Exclusion of participants
​
We also reserve the right not to admit individual participants to a seminar or to exclude them from (further) participation for important reasons, for example due to disruption of the event or failure to comply with the seminar leader's instructions. The seminar fees will not be refunded.

§5 Right to change
We reserve the right to make any necessary changes and deviations in content and organization before or during the seminar, provided that these do not significantly change the overall character of the announced seminar.

a. Dates & Locations
We also reserve the right to change the dates and times published on this website as well as the seminar location. We will inform registered participants immediately of any necessary changes.
§6 Consulting, Mentoring
If we carry out individual mentoring and consultations, these terms and conditions also apply. For such mentoring and consultations, an effective contractual relationship is legally established even if the appointment is made verbally or by telephone. By commissioning us, the client accepts these conditions.

Dr. Shirin Mansouri provides her services on the basis of the data and information provided to her by the customer or his representatives. The customer is responsible for the accuracy and completeness of the information. The work to promote and develop the personality of customers/participants is carried out to the best of our knowledge and ability. Unfortunately, no guarantee of success can be given.

a. Fee
The client owes us a previously agreed fee. Unless otherwise agreed, the fee is to be paid by bank transfer within 14 days of invoicing.
​
b. Cancellations
Coaching or consultation can be cancelled free of charge up to 48 hours before the appointment. If cancelled later or if the appointment does not take place without prior notice, the agreed amount will be due in full.

c. confidentiality obligation
We undertake to treat all documents and information received as confidential.

§7 Offsetting, retention
The participant is only entitled to set off if his counterclaims have been legally established or are undisputed by us. In addition, he is only entitled to exercise his right of retention to the extent that his counterclaim is based on the same contractual relationship.

§8 Disclaimer
The concept DR. MED. SHIRIN MANSOURI - HYPNOSIS, SEMINARS & WEBINARS does not represent medical or psychotherapeutic treatment. It is not suitable for dealing with psychological disorders. Participation in the seminars or consultations/coaching is voluntary and at your own risk.

a. Right to compensation
The participant's claims for damages, regardless of the legal basis, are excluded. Excluded from this are claims for damages by the participant resulting from injury to life, body or health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty on our part, our legal representatives or vicarious agents.

b. Essential contractual obligations
DR. MED. SHIRIN MANSOURI - HYPNOSIS, SEMINARS & WEBINARS is only liable if it has breached a material contractual obligation. Material contractual obligations are abstractly defined as those obligations whose fulfilment enables the proper execution of the contract in the first place and whose compliance the customer can regularly rely on. In these cases, liability is limited to compensation for foreseeable, typically occurring damage. In the event of a breach of material contractual obligations, we are only liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless it concerns claims for damages by the participant arising from injury to life, body or health.

c. Restrictions
The restrictions in paragraphs 2 and 3 also apply to the benefit of the legal representatives and vicarious agents of DR. MED. SHIRIN MANSOURI - HYPNOSIS, SEMINARS & WEBINARS if claims are asserted directly. It is also pointed out that the seminars cannot replace an operation.

No further claims can be made against DR. MED. SHIRIN MANSOURI - HYPNOSIS, SEMINARS & WEBINARS. In particular, any claim for reimbursement of travel and accommodation costs as well as loss of work is excluded unless such costs arise due to grossly negligent or intentional conduct on the part of DR. MED. SHIRIN MANSOURI - HYPNOSIS, SEMINARS & WEBINARS. We undertake to do everything reasonable to help resolve or limit any disruptions to performance.
§9 Notes on data processing
We collect participant data as part of the processing of contracts. In doing so, we observe the provisions of the Federal Data Protection Act and the Teleservices Data Protection Act.
Without the participant's consent, we will only collect, process or use the participant's inventory and usage data to the extent that this is necessary for the execution of the contractual relationship and for the use and billing of teleservices. Without the participant's consent, we will not use the participant's data for the purposes of advertising, market or opinion research.
The customer has the opportunity at any time to obtain information about the data stored by him and to request the deletion of this data. Furthermore, with regard to the customer's consent and further information on data collection, processing and use, reference is made to the data protection declaration, which is available in printable form on our website via the "Terms and Conditions/Data Protection" button.

§10 Copyright
The conference documents are protected by copyright. The reproduction, distribution or other use of the conference documents is only permitted with the express written consent of Dr. Shirin Mansouri.

a. Sound, photo and film recordings
​
During the seminars, sound, photo and film recordings are made. Sound recordings can be published without consulting the participant, as long as their name is not included in the sound recording. If a photo or film sequence is published, the participant will be informed of the planned publication by email and/or telephone. They will then have the opportunity to object to the planned publication. If they do not respond within 14 days of the request to release their image or video for publication, the release is deemed to have been granted. The participant is not entitled to any separate compensation.

b. Declaration of consent
​
By registering for the seminar, each participant agrees to the recordings and publication. Any disruption to the seminar, which will be kept as minimal as possible, does not entitle participants to a refund of the seminar costs or to any other compensation.
§11 Final Provisions & Place of Jurisdiction
The contractual relationship between us and the customer is subject to the law of the Federal Republic of Germany.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of performance for all obligations of both contracting parties and the place of jurisdiction for all disputes in connection with this contract is Frankfurt. We are also entitled to bring legal action at the customer's registered office.

§12 Severability Clause
The invalidity of individual provisions of this contract does not affect the validity of the remaining provisions or the existence of the contract as a whole. Unless dispositive statutory law applies, the invalid provision will be replaced by a provision that comes closest to the economic content of the invalid one. The same applies in the event of a gap.
